Bookings

Bookings can be made online, by telephone or by email. A deposit for 50% of the value of the booking is required at the time of booking. Telephone and email bookings require payment by bank transfer and are not confirmed until you have received a booking confirmation by email.

Payments, cancellation and refunds

We ask for 50% of the value of your booking at the time of booking. This is a non-refundable deposit that we require to hold the dates for you. We ask for the remaining 50% to be paid 14 days before the first day of your stay. We will advise you of this date at booking and will send a reminder closer to the time. If you book within 2 weeks of the start date of your holiday, the full price will be due at time of booking. If your circumstances change and you are going to be unable to make your booked holiday, we will waive the remaining 50% cost if you let us know more than 42 days before the first day of your booked stay. If you wish to change the date of your booking before full payment has been made, we will do our best to accommodate you, subject to availability. If you need to cancel your booking after full payment has been made (within 14 days), we are unable to refund your holiday cost. In the event of the Owner receiving a Cancellation Notice within and including 42 days of arrival, the property will be re-marketed for the cancelled holiday dates. In the event of the property reselling for the full price, the owner will return the Cancellation Charge minus a £30 cancellation administration fee. If the property resells for a lesser price, the guest will be refunded the lesser price minus the £30 administration fee.

To cancel your booking, please let us know as early as possible and confirm by email. We will do everything we can to avoid changing or cancelling your booking after confirmation but in the event this is unavoidable we reserve the right to do so and would notify you as soon as possible. The Owner reserves the right to decline bookings at their discretion. In such cases all sums of money paid by the Guest in relation to the Holiday will be refunded immediately. Guests are required to take out cancellation and holiday insurance

Security deposits​

In advance of check in, we require a £500 security deposit to cover any losses or damages incurred during your stay. We recommend you pay this with a credit card as with a credit card the amount due will be provisionally held as an authorised amount, without being charged, and will be released at the end of your stay if there have been no problems. If using a debit card, the funds may actually leave your account and, once reimbursed, may take a few days to clear. Please check with your bank for full details if you are unsure. The Security Deposit will not be taken from pre-authorised cards unless there is a problem found with the Property or its contents after departure. All or part of the Security Deposit may be retained if the Property is not left in the clean and tidy condition in which it is found, to cover the cost of any additional cleaning and laundry required over the usual designated amount, removal of excess rubbish, any damage to the Property contents, the replacement of bedlinen or towels, or the Owners insurance excess if a repair or replacement exceeds the specified deposit amount.

Arrival and departure times

Check-in for booked holidays at Rosa Joss Bay is from 3pm. Check out is by 10am at all properties unless agreed with the hosts beforehand in writing.

House rules

Making a booking at Rosa Joss Bay, gives you access to the named property for the period stated in your confirmation for the purposes of a holiday let only. By making a deposit payment of 30% you enter a contract with the property owners and agree to the following booking conditions and house rules.

• Party leader’s responsibility. By making a booking with us (and paying the 30% deposit), you take responsibility as party leader. The booking will be made in your name and we will require your postal address, a valid email address and a telephone number. We will also require the number of adults and children due to stay at the property, along with the children’s ages. You will be responsible for making sure all party members adhere to the house rules. On departure all windows and doors must be checked and securely locked. Keys must be returned to the key safe and the key safe locked properly. In the event that keys are not returned, then a charge will be incurred by you, the Guest to cover locksmith costs to change locks and replace keys.

• Check in and check out. You agree to adhere to our check-in and check-out times as stated above on the dates stated in your booking confirmation – unless otherwise agreed.

• No under 18s without supervision. We cannot accept bookings from or for under 18s without adult supervision and we expect children to be supervised at all times within our properties.

• No hen or stag parties and no single-sex group bookings. We do not accept bookings for hen or stag celebrations, parties or for single-sex groups of 3 people or more.

• No Pets. Unfortunately we do not allow any pets during your stay.

• No Smoking. Smoking of tobacco in any form or E-cigarettes is not permitted inside the Property. Smoking is permitted outside the Property on condition that all cigarette butts and ash are cleared and disposed of, by you, the Guest, before departure

• Keeping it clean. You agree to leave the property clean and tidy on your departure. This includes washing, drying and putting away any crockery, cutlery and kitchen utensils used. Please turn down beds that have been slept in and check that you have all your belongings with you.

• Damage or problems during your stay. We hope your holiday goes without a hitch but if there is any damage to the house or its contents during your stay, please let us know by contacting us using the details above. You agree to pay for any damage caused wilfully or by misuse which includes breaking the rules as set out here and for any special cleaning necessary. Payment for this will initially be taken from the security deposit we hold but any repairs or extraordinary cleaning which exceeds the £500 deposit will be payable by the party leader within 10 days of our request. Emergency contact details are provided in the house should you need us to contact us during your stay for emergency maintenance or repairs. To pay for any losses or damages to the Property and contents caused by The Guest or a member of their party (reasonable wear and tear excluded) and inform the Owner immediately so items can be replaced or repaired prior to the arrival of future Guests

To take good care of the Property and leave it in a clean and tidy condition at the end of the Holiday, with exception of linen to be laundered. A cleaning service is not provided during the Holiday unless otherwise agreed with the Owner (charges apply). Should the Owner be dissatisfied with the condition of the Property upon the Guests’ departure, the additional cleaning will be charged at £20 per hour and will be claimed from the Security Deposit.

• Recycling and rubbish. Please help us with recycling. There is information available in the house and in the bin area to explain what can and cannot be recycled in our area. We ask that recyclables be washed and put loose in the relevant bins outside while general waste is bagged. It is the Guests’ responsibility to make sure that rubbish and recycling from inside the Property is placed in the correct rubbish bins, (Black for general waste, Blue for recyclable plastic and glass, Red for cardboard and paper). Refuse collection day is Wednesday and the Owners’ are permitted to enter the alleyway on a Tuesday (or other day in the event that your Holiday falls in a Bank Holiday week and collection is delayed) in order to move the correct bin to the outside of the Property for collection the following morning. The Owners will replace the bin following refuse collection. In the unlikely event you should fill a bin during the course of your Holiday please notify the Owner and do not leave overflow rubbish outside the Property. We kindly ask that guests help by putting the appropriate bin at the end of the shingled path by the gate on a Tuesday night, ready for collection on Wednesday morning.

• Respect our neighbours. You agree to respect our neighbours and the community in which our properties are based. This includes keeping noise to a minimum, especially in the evenings. Quiet times from 10pm-8am.

• Stay safe! We take every step we can to make our properties safe for all our visitors including providing guards for the BBQ, warning signs, baby gates at Rosa Joss Bay, but staying safe requires your co-operation too. Please use the safety equipment available, take care and supervise children at all times.

Fire safety and Sprinkler system

Not to leave the log burner in the Property unattended when lit. The log burner should only be used when Guests plan to be in attendance during the period of burning.

Not to burn any candles (including but not limited to decorative and scented candles, oil burners and birthday candles) in the Property.

The house is equipped with a Sprinkler system, if this system is activated by mistake due to the guests actions, then they will be liable for the cost of replacing the damage caused by the sprinkler.

Guest Obligations

To permit the Owner and their employees (including but not limited to cleaners, gardeners and workmen) reasonable access to the Property as required during the Holiday.

Not to part with possession of the Property, or share it, except with members of the party shown on the Booking Form. All Guests at the property must be notified to the Owner at the time of booking.

Not to sell or transfer the booking to another party without the Owners’ express written agreement.

Not to exceed the total number of 9 people– a cot may only be occupied by a child aged 24 months or less.

Not to cause an annoyance or become a nuisance to occupants of adjoining premises.

Not to commit or allow any of your party to commit any act which breaks the law, not to use the Property for any commercial or illegal purpose, not to sublet the Property as a whole or part thereof or otherwise allow anyone to stay who, the Owner has not previously accepted as being part of your party.

Not to hold events, such as parties, celebrations or meetings in the Property without the prior consent of the Owner

Not to undertake any unscheduled photoshoots. Please contact the Owner regarding use of the Property and its grounds for your photoshoot (charges may apply)

To comply with any current government guidelines.

Any guests found to be staying at Rosa Joss Bay who were not on the booking or the party exceeds 6 adults, will be liable to a charge of $50 per person per night.

Liability

The Owner accepts no responsibility for any damage, injury or illness caused by use of the accommodation and any amenities and such use is at the Guests’ own risk. The Owner cannot be held responsible for (and cannot accept liability for) issues outside their reasonable control such as breakdown of domestic appliances, plumbing, electrical problems, structural repairs, non-working Wi-fi, poor TV reception, invasion of pests, infestations or damage caused by exceptional weather conditions, or by noise and disturbance resulting from nearby building works, noisy neighbours or local events.

Nothing in these clauses excludes or limits the liability of the Owner;

for death or personal injury caused by the Owners’ negligence.

for any matter for which it would be illegal for the Owner to exclude or attempt to exclude their liability.

Rosa Joss Bay, their owners and employees accept no liability for loss or damage to possessions and/or personal injury. By making a booking with us you accept full responsibility for your own property, your safety and the safety of those in your party including your children.

Personal Belongings

If the Guest, or any members of your party leave any personal belongings behind at the Property after departure, the Guest will be charged the cost of postage and packaging and an administration fee of £10 to have them returned. Any items found at the Property will be disposed of within 30 days if not claimed. All perishable foods will automatically be disposed of at the time of the changeover


Non-availability of Property

If for any reason beyond the Owners’ control the Property is not available on the date booked (owing, for example, to flood damage, failure of heating etc.) all rent and charges paid in advance by the Guest will be refunded. Please note that refunds may take up to 30 days to be processed. 

Complaints

All complaints must be notified to the Owner as soon as reasonably practicable (but in all cases during the period of the Holiday) as they may be required to carry out an on-the-spot investigation and if necessary, take remedial action. Guests have a legal obligation to mitigate their loss. Notification of complaint should be made by email to rosiefpm@gmail.com or by telephoning 07554 740329

If the Owners’ are denied the opportunity of investigating the complaint within a reasonable time or denied the opportunity to put matters right during the Holiday, then the Guest will waive all rights. All complaints relating to the cleanliness of the property should be reported within two hours of entry to the property.

No correspondence can be entered into concerning complaints made upon departure or after Guests return home

Data and Privacy

In making a booking we will ask for personal information such as your name, postal address, email address, telephone number and payment details. We may use the data to inform you about news and information we think may be of interest to you. We will not pass your information onto any third parties for the purposes of administration. By booking with us you are deemed to have consented to the use of personal information for this purpose.

Rosa Joss Bay is committed to protecting your privacy. We will only use the information that we collect about you lawfully, in accordance with the Data Protection Act 1998.

Governing Law

The Owner and the Guest agree that the law applying to this Contract will be English law and that we agree that the jurisdiction of the English Courts shall apply in any dispute or claim arising out of this agreement.

These Terms and Conditions have been put together in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (CCRs).
